      Hi Shannon
According to the US Supreme Court of May 10th 1893, the tomato is legally a vegetable, because it is used as a vegetable (in main courses rather than dessert). However, botanically it is a fruit and even the US Supreme Court can’t change that! Arkansaw have declared it as both the State Fruit and State Vegetable, so it looks like people are pretty confused on this point!

A fruit, if my rather weak botany has not failed me – the key is the presence of the seeds, which means its a fruit.
