They are called a cake and they are spongey so i would say cake. Some people think they are really a biscuit because people eat them instead of other types of biscuit with coffee or tea. Legally they are a cake – this was decided in 1991. In the UK there is less tax to pay on chocolate covered cakes than on chocolate covered biscuits, so this is quite important. I will now enjoy a small cake.
They are a cake because cakes go hard when left out and biscuits go soggy. Personally I never leave any cakes or biscuits long enough to test this theory but I have had many an argument with friends over this and this is what we settled with!
